If you are experiencing domestic abuse or domestic violence from a partner or ex-partner, or feel threatened by their presence, it can be an extremely difficult and frightening situation to be in, and it is not something you have to face alone.
Whatever your circumstances, there are legal options open to you, and we will move quickly to get you the protection you need.
Our domestic abuse solicitors approach these situations with care and understanding, and can explain the legal protection available to you clearly, without judgement, so you can decide what feels right for you and your family, at whatever pace you need. We know these are not straightforward conversations, and we will not rush you into decisions before you are ready.
The protection available
There are two main legal orders that can offer protection. A Non-Molestation Order is designed to stop someone from harassing, threatening or harming you, whether that protection is for you personally or for a child you are responsible for. In legal terms, molestation covers any activity that causes harassment serious enough to need the court to step in. An Occupation Order allows you to apply to regulate usage of the family home or remove someone from a shared property to keep you safe, and it does not affect either person’s financial rights in that property — it is purely about your immediate safety, whatever else is still being worked out between you.
Preventing harassment
Where harassment is affecting your physical or mental wellbeing, the Family Law Act 1996 can be used to apply for an order preventing the person from continuing that behaviour. We can talk you through what this involves and whether it is the right route for your situation.
Every situation is different
No two situations are the same, and what feels right for one person will not always feel right for another. Some people want to explore their options quietly before deciding anything, while others need to act quickly. Whatever position you are in, we will listen first and let you set the pace, rather than assuming what you need.
Getting help
It is important to get legal advice and support as early as possible, both to protect yourself and any children involved. You do not need the other person’s consent to apply for an Occupation Order, and asking for help is nothing to feel afraid of. This is exactly the kind of situation the law, and our family team, are here for, whatever stage you have reached and however long you have been dealing with it.
