The death of a loved one can bring old family tensions to the surface, particularly where the validity of a will is in question or someone feels they have not been properly provided for.
These disputes can be extremely bitter, and in some cases cause permanent rifts within a family that last for years afterwards.
We give initial advice on where you stand as soon as you come to us, so you are not left guessing about your position at an already difficult time. Acting sooner rather than later matters in these cases, since evidence can be harder to gather and positions can harden the longer a dispute is left unresolved.
Disputing a will
We advise on disputes over a will’s validity, whether on grounds including a lack of mental capacity, undue influence or otherwise at the time it was made.
Inheritance and estate disputes
Where someone feels they have not been properly provided for, we can advise on a claim under the Inheritance (Provision for Family and Dependants) Act 1975, which allows certain family members and dependants to apply to the court for reasonable financial provision from an estate. We can also act in disputes involving executors or trustees who are not carrying out their duties properly.
Resolving these disputes without going to court
Even the most seemingly intractable disputes can sometimes be settled on terms acceptable to everyone involved, and a solution is often closer than it first appears. We work with you to find a resolution using mediation or another form of alternative dispute resolution where that is appropriate, rather than defaulting straight to litigation, which tends to be slower, more expensive and harder on family relationships that may already be under strain. We understand these disputes are personal, and that there is often more at stake than the financial claim itself, so we take the time to understand what actually matters to you before advising on the options available.
