Wills & Inheritance disputes
In the event of a death of a loved one, the validity of a will can be challenged and may give rise to a family battle. Disputes about wills and inheritance can be extremely bitter, in some cases causing permanent rifts in families.
If you find yourself in this situation, you need to get legal representation sooner rather than later. We will advise on where you stand legally and work with you to find a solution, using mediation or another form of alternative dispute resolution, if appropriate. Even the most seemingly intractable disputes can sometimes be settled on terms acceptable to all parties. A solution may be closer than you think.
We can help with claims and disputes in relation to;
- Disputed wills based on allegations of fraud, mental capacity and undue influence
- Negligently drafted wills and professional negligence claims
- Claims under the Inheritance (Provision for Family and Dependants) Act 1975
- Disputes involving Executors or Trustees
- Disputed Powers of Attorney
- Legacies due to charities
- Lost or destroyed wills
- Execution of wills
We understand that these disputes are personal and that there may be more to it than just a financial claim. Whatever the nature of your claim we can advise you and discuss what options you have available to you.
Small claims
These days, most disputes involving sums up to £10,000 count as “small claims”. That means you don’t get your legal costs back, even if you win, so many people are forced to represent themselves – even when difficult legal issues arise.
At Hine Solicitors, we understand that for most people, £10,000 is a lot of money. That’s why we offer a special small claims assistance service, with realistic fixed fees for each stage of the case. Contact us for details and don’t go into court without legal advice.
Judicial Review
Judicial review is a process where the High Court consider whether a public body has acted irrationally, unreasonably or unlawfully.
We are able to assess whether you have grounds to judicially review a decision made by a public body which would include, amongst others:
- Secretary of State for Justice
- Chief Constables and Prison Governors
- The Parole Board
- Her Majesty’s Court Service
- National Probation Service
We are able to represent individuals that qualify for Public Funding. If you do not qualify we can discuss funding your case on a private basis.
